Signed into law in June 2025 and taking effect on January 1, 2026, TRAIGA applies to any AI system used in Texas that significantly influences decisions in areas like employment, housing, credit, insurance, education, healthcare, legal rights, or access to government services. In other words, if your AI system helps decide who gets what, or who doesn’t, you are in TRAIGA’s scope. The law is built around three concepts. First, intent. You cannot develop or deploy AI systems with the purpose of manipulating, discriminating, deceiving, or harming. That includes using AI to encourage criminal behavior or self-harm, discriminate against protected classes, or scrape biometric data without consent. Second, risk. High-risk systems that affect core rights or opportunities face additional obligations like transparency, recordkeeping, and auditability. Third, accountability. If you use AI to make or influence important decisions, you need to be able to explain how it works, prove that it aligns with policy, and document that you took steps to prevent harm.

One of TRAIGA’s biggest shifts is the requirement that individuals be notified, in clear and accessible terms, when they are interacting with or being evaluated by AI. This can’t be buried in fine print or legalese. It needs to be surfaced at the point of interaction. Just as importantly, individuals must be able to request a plain-language explanation of how a decision was made. That requires building explainability into the system from the start. Not generic white papers, but context-aware summaries of which inputs mattered and why. These explanations must be automatically generated and stored alongside the decision logs.
All of this needs to roll up into a central system of record. Legal, compliance, and executive teams need real-time visibility into which AI systems are in use, which are classified as high-risk, which have passed recent assessments, and where open risks or unresolved user appeals exist. Logs, approvals, disclosure confirmations, model changes, and user feedback should all be stored in a single, accessible platform. When a regulator or oversight board comes calling, you should be able to answer their questions with documentation, not delay.

Starting January 1, 2026, organizations that develop or use high-risk AI systems must be able to explain how they work, prove they align with clearly defined policy, and produce documentation that shows how risks are managed over time. That includes live inventories, enforceable policies, testing protocols, real-time explainability, and centralized oversight. It is not a theoretical standard. It is an operational one. And it applies whether you build your own models or rely on a vendor. If your system influences housing decisions, job access, eligibility for services, or any area TRAIGA classifies as high-risk, this law applies to you.
